MONEY, MONEY, MONEY!
In this issue we are again bringing to you the text of the appeal for the constitution of the permanent International Penal Court, enriched today by some of the most remarkable adhesions we have received so far. Nobel price recipients, Parliament members from several countries, regional and local deputies and ordinary citizens have given their support to this appeal to the United Nations general secretary, to the president of the General Assembly and to all governments adhering to the UN. They all signed in order to give the planet a permanent court of justice by calling for an International conference.
Our task is to let American citizens know who and how many people have signed the appeal; a special task since, as it seems, some American diplomacy wants to delay indefinitely the historic decision of starting the proceedings which will lead to the setting up of the International court in the upcoming section of the UN general assembly. We must be able to inform the American citizens, as well as worldwide foreign affairs representatives to the UN, about the large number of adhesions and strength that the appeal is contributing toward the political will in creating the court.
Once more we must keep up the demanding economic effort of the Radical Party in publishing two commercial pages on its history and its initiatives on the prestigious "New York Times", as here reported.
This is why we started the "New York, New York" campaign. A campaign intended to reach the public opinion, specifically American readers, to make it aware of how important the discussion on the institution of the International court and the moratorium on death penalty are.
Therefore, the "New York, New York" campaign is, at the same time, a self-supporting campaign, through which we hope to make this information possible for American citizens.
We insist on the economic aspect of this initiative, on the necessity of getting enough money in time - that is, immediately - to publish more pages of information in American newspapers and particularly on the "New York Times": Americans must know in order to evaluate the position assumed by Washington.
On the pages we can afford to buy, we will report the names of all those people and institutions who made the ads possible.
We need the money today for those ads and for sending an International delegation of the highest level to Washington to meet the US vice-president Al Gore.
In a few days the Radical Party has already received thousands of dollars, but a much greater financial support is needed. Everybody should feel responsible for the positive result of such an essential and important campaign.

DEATH PENALTY FINALLY ABOLISHED IN ITALY.
Italy is now the 54th country in the world to have totally abolished the death penalty, by removing it also from its military codes.
On October 5, the bill already passed by the Senate last August, was finally converted into State law by the Italian Parliament.
During the debate demonstrations by Radical Party and by "Hands Off Cain!" members took place.
The abolition of the death penalty is not only of major importance for Italy herself, but also for the current session of the UN General Assembly.
The Italian government is to produce - by the Parliament unanimous vote - a resolution for a universal moratorium of executions.
As we mentioned in the last issue of Trasnational, the Italian Senate has approved this project by a compact vote and the House of Representatives voted accordingly, with only few abstentions.

PERMANENT INTERNATIONAL COURT
The president of the 6th Commission declares his interest to the issue.
During her visit in New York, Emma Bonino, Italy's representative for the Italian position at the UN, met with the president of the 6th Commission (Juridical Affairs) who will examine the International Court issue for a report by the International Law Commission. The debate on this point is fixed for the two weeks between October 24 and November 4, 1994.
The president demonstrated his great interest and promised his personal involvement as president of the Commission as well as for the International Law Commission recommendations on the matter.

Radical Party representatives meet with US ambassadors.
In the last few days, members of the Radical Party sent a letter to US ambassadors asking for a meeting to discuss the foundation of the International Court after the position taken by the American government.
The letter also reads :"I learn with surprise the American government declaration that it is too soon for calling a meeting for the establishment of the Court, deferring the issue debate to another committee, such as a forum of all the States"..."If this position were definitive one would delay sine die the set up of the International Court for crimes against humanity, in the meanwhile depriving the International community of a precious instrument against all those imposing their own will with force and violence."
The letter to the American ambassadors also recalled that during the opening of the 49th session of the UN General Assembly many states have expressed support for the constitution of an International Penal Court: Germany (for the EEC ) Italy, Holland, Croatia, Ireland, Canada, Australia, Sweden, Trinidad and Tobago Island. Relevant is also the number of supporters among Parliament representatives, personalities and ordinary citizens from all over the world.
During the next few days, members of the Radical Party will meet with UN officers to illustrate them the initiative and the good results obtained so far, pleading for the presentation of the matter to the UN secretary.
New York, October 7.
The US government believes it is too early to call for an International conference in order to form the International Permanent Penal Court and suggests to postpone such a decision during the General Assembly 50th session.
The United States proposes the constitution of a committee ad hoc to discuss the statute for the International Penal Court prepared by the International Law Commission.

Statement by Emma Bonino, secretary of the Radical Party:
"I consider the position taken by the US government serious and unbearable, both for content and form.
As far as the form is concerned, the US government chose to address directly the government offices, neglecting both the various UN representatives and the discussion that will be soon taking place at the UN.
As for the content, with its declaration the US government seems to be willing to forbid to the present session of the UN General Assembly to decide for the calling during 1995 of the International conference, which should found the International Penal Court. This position is supported by several governments according to statements of the last days.
More serious still is the fact that the US government maintains with the other States that this committee will facilitate a statute for the International Penal Court that they could support.
The Radical Party together with the thousands of Parliament representatives who signed the appeal, thinks that after more than 40 years of discussion the moment has arrived for the creation of a new International jurisdiction: this could be possible in a few weeks.
This is my position, as well as the position of the Italian government which I represent with the work of the of UN 6th Commission that will discuss the subject starting October 24".

TO THE GENERAL SECRETARY OF THE UNITED NATIONS

TO THE REPRESENTATIVES OF THE MEMBER STATES
We the undersigned,
Parliamentarians, members of government, and citizens of the member states of the UNO:
In consideration of the fact
- that all over the world, from the former Yugoslavia to Rwanda and to the many tragic aggressions and wars, dramatic conflicts persist and continue to flare up in the name of ancient nationalistic and ethnic sentiments or of absurd and unacceptable religious incomprehension, and that these conflicts are marked by atrocities that seem to bring back the violence and the horror of the totalitarian regimes;
- that it is therefore now necessary to create a valid body of international law and jurisdiction which, by expressing and giving concrete force to the desire for justice felt by men and women of good will, can manage in an effective and credible manner to identify and punish those responsible for crimes condemned by the common conscience;
- that it is up to the international community - and thus to the United Nations, the expression of the will of free peoples and governments - to create and support, as soon as possible, this form of new law and jurisdiction through the institution of a permanent Tribunal on crimes against humanity, which can effectively take up at a global level the work begun by the ad hoc Tribunal on the crimes committed in the former Yugoslavia;
- that the International Law Commission has been working since 1947 on the drafting of a Code of crimes against the peace and security of humanity, a Code which the UN adopted at first reading in 1991;
- that the 48th General Assembly (1993) conferred on the same Commission a priority mandate to draw up the Statute of an International Penal Tribunal, in time for adoption by the 49th General Assembly (1994);
- that the International Law Commission finally completed a draft Statute in its 46th session (May-July 1994);
we appeal to the Secretary General of the United Nations, the President of the General Assembly, the President of the VI Commission of the General Assembly, and the representatives of the member states to assume a determined and urgent procedural initiative to ensure that the General Assembly, on the occasion of its 49th session (September-December 1994)
- discusses the draft Statute drawn up by the Commission and convenes a United Nations Conference in 1995 for the approval of the Treaty relative to the institution and operation of the International Penal Tribunal.
