MEASURES TO PROMOTE JUDICIAL COOPERATION

Extradition

It is recommended that States should:

(a) review their domestic legislation and treaties to identify possible ways to simplify procedures for extradition and also simplify or reduce any onerous evidentiary requirements to the minimum required;

(b) make clear to other States the competent authority or authorities designated to receive, respond and process extradition requests. In that regard, communication of the name, address and telephone numbers of the authority or authorities to the United Nations International Drug Control Programme in a manner similar to that provided for the communication of the designated authorities for mutual legal assistance in article 7, paragraph 8 of the 1988 Convention would be useful.

(c) prepare a summary on their domestic extradition practice to make available to other States, especially neighboring States;

(d) subject to national legislation, constitutional provisions and treaties, consider extraditing their nationals for serious drug offences on agreement tnat they will be surrendered for prosecution but that they could be returned to serve any sentence imposed in the state of nationality;

(e) utilize, where appropriate, as a resource the United Nations Model Treaty on Extradition when negotiating such treaties;

(f) utilize, as appropriate, modern technologies to facilitate communications as long as they are secure and consistent with domestic legal systems.
