The German court in Trier, decided to deport a Tibetan refugee named Jampa Tenzin Kungashar, 26 year old, to China, on or by 25th August '94. The same court rejected the claim by the Tibetan of his danger if returned to china after seeking asylum abroad, Judge Klages said, "The court does not believe that the claimant is a Chinese citizen. It therefore appears to be out of the question that the claimant on his return (to China) will face persecution for 'fleeing from the Republic (of China).
Germany drops plan to deport the refugee because : a) On May 26, when the former monk was put on a plane from Frankfurt to China, the pilot refused to accept the passenger. b) Pressures from Tibetan supporters in Germany, c) A speedy decision came from the Indian authorities on humanitarian grounds to help the Germans by accepting the refugee in India.
