INTERNATIONAL PETITION FOR THE IMMEDIATE SETTING UP OF THE INTERNATIONAL
COURT TO JUDGE WAR CRIMES IN THE EX-YUGOSLAVIA
ABSTRACT: Appeal soliciting the highest organs of the United Nations to
achieve all conditions and necessary requirements to make the international
tribunal on the former Yugoslavia operative by December 1993.
The text of this international appeal has also been sent to the radical MPs
of the various countries, to be transformed into a resolution or other
instrument of parliamentary initiative.

We the undersigned, parliamentarians, members of political groups, men and
women from academic, scientific, cultural and religious circles, and
citizens from all over the world:
A. Considering that the U.N. Security Council, in accordance with Clause
VII of the Charter, has decided, by passing Resolution no. 827 of 25 May
1993 and on the basis of the report prepared by the Secretary General, to
set up the International Court to judge and punish those responsible for
serious violations of International Humanitarian Law committed in the
territory of the Ex-Yugoslavia;
B. Considering that it is now necessary to respect the urgent deadline, set
by that same Security Council, for the actual constitution of the Court;
for the appointment of the Public Prosecutor and of the judges, and their
taking office in the Hague, where the Court will be set up; and for the
conducting of inquiries and investigations prior to the actual trying of
the cases;
C. Considering that the ad hoc Court's becoming operative as soon as
possible constitutes an extremely important step forward in upholding the
supremacy of human rights and of the law, and in creating international
jurisdiction with an aim to setting up a Permanent Court authorized to
judge and punish people who have committed international crimes;
Having stated this, and to achieve the following aims
WE THE UNDERSIGNED
1. Address a FORMAL APPEAL
To the Secretary General of the U.N.
To the President, and the members of the U.N. General Assembly
To the President, and the members of the U.N. Security Council
so that each may take action, within the sphere of their respective
authority and responsibilities:
a) - in order to fulfil the necessary conditions and to complete the
required technicalities for the International Court to judge war crimes in
the Ex-Yugoslavia to be set up by December 1993;
b) - in order to enable the U.N. General Assembly, during its next Session,
to come to the necessary decisions for seting in motion the required
procedures for the constitution of a Permanent International Court;
2. We engage ourselves to take the necessary steps, within our own
particular sphere, in order that our governments might take action both on
the domestic front and within the United Nations, to achieve the above
objectives.

The text of this International Petition can be incorporated into a motion,
or another form of parliamentary initiative.
To this end, it is sufficient to address the two principal aims of the
petition (a) and b)) to your respective governments, in order that they
might commit themselves to achieving these objectives.
We would be grateful if you could keep us informed of any initiatives
undertaken.
