MARYLAND **CONSENSUAL** WEEK OF APRIL 25, 1994 GAS CHAMBER
JOHN F. THANOS, (White), age 44, has been on death row since
March 1992. He was convicted of the robbery/murder of 2 white
males and 1 white female. Thanos has been actively trying to drop
his appeals since he was convicted. A death warrant was signed
despite pleas by Thanos's family to delay the execution order
until after federal public defenders get a hearing to renew
arguments that Thanos suffers from a severe mental disorder and
was not properly represented at his murder trials.

UPDATE ON GARY GRAHAM's CASE in Texas from the Gary Graham
Justice Coalition
On March 17, 1994 at 9:00 am in Houston, Texas an oral
argument on Gary Graham's federal habeas petition was held.
Richard Burr, NAACP Legal Defense Fund, argued for a full
evidentiary hearing for Gary Graham before a three judge panel of
the Fifth circuit. The arguments lasted 2 hours before a packed
courtroom where Graham supporters outnumbered the opposition
"Justice For All", calling for Graham's immediate execution, by
at least 2 to 1. Attorney Burr fielded question from the three
judges: Gadwood, King and Jolly in an intense 55 minute volley of
why Gary's case demands a hearing. The five crime scene
witnesses, four of whom have never been heard in a court of law,
were the most compelling of the arguments setting forth that
Graham was not the man they saw that May 1981 evening in a
Houston Safeway parking lot.
The state acknowledged that their entire case rested on one
witness who sat in her car in the dimly lit parking lot 33-44
feet from the shooting. The witness identified Graham as the
shooter from a highly suggestive photo-based lineup. Graham was
the only man in both the photo arrays and the lineup and the only
man who had both a "short afro and no facial hair", the two
characteristics all the witnesses agreed upon.
The three-judge panel has no deadline for making a decision,
but is expected to rule on the request for a full and fair
hearing in three to four months.
Meanwhile the Texas Criminal Court of Appeals ponders over
the civil suit brought by Graham's attorneys that the Texas Board
of Pardon and Paroles must meet and hold a fair hearing into
Gary's case. The hearing in that case was held December 1, 1993.
A ruling is expected anytime from the 9 justices in that court.
