L'Assemble'e ge'ne'rale,
Rappelant ses re'solutions 47/33 du 25 novembre 1992 et 48/31 du 9
de'cembre 1993,
Rappelant e'galement ses re'solutions 49/53 du 9 de'cembre 1994 et
50/46 du 11 de'cembre 1995,
Conside'rant que, dans sa re'solution 51/207 du 17 de'cembre 1996,
elle a de'cide' de re'affirmer le mandat du Comite' pre'paratoire pour la
cre'ation d'une cour criminelle internationale, et de'cide' e'galement que
le Comite' pre'paratoire sie'gerait du 11 au 21 fe'vrier, du 4 au 15 aoet du 1er au 12 de'cembre 1997, ainsi que du 16 mars au 3 avril 1998, pour
achever la re'daction d'un texte de synthe`se susceptible d'emporter une
large adhe'sion, qui serait pre'sente' a` la Confe'rence diplomatique de
ple'nipotentiaires,
Rappelant que, dans sa re'solution 51/207, elle a de'cide' en outre
qu'une confe'rence diplomatique de ple'nipotentiaires se tiendrait en 1998
en vue d'achever et d'adopter une convention portant cre'ation d'une cour
criminelle internationale,
Conside'rant qu'il importe de mener a` bonne fin les travaux de la
Confe'rence en encourageant la recherche d'un accord ge'ne'ral sur les
questions de fond,
Notant qu'a` sa 51e se'ance, le 21 fe'vrier 1997/1/, le Comite'
pre'paratoire a accueilli avec satisfaction la proposition du Gouvernement
italien tendant a` organiser la confe'rence diplomatique a` Rome, et a
recommande' a` l'Assemble'e ge'ne'rale qu'en application a` la re'solution
51/207 de l'Assemble'e et apre`s examen par le Comite' des confe'rences,
une de'cision conforme a` cette proposition soit prise lorsque seraient
examine'es les dispositions ne'cessaires a` la tenue de la confe'rence,
e'tant entendu que, pour l'organisation de la confe'rence a` Rome, la
pratique habituelle concernant le financement des manifestations de cet
ordre qui ont lieu hors du Sie`ge de l'Organisation des Nations Unies ou
des autres villes sie`ges de l'Organisation sera suivie,
Prenant acte du rapport du Comite' des confe'rences/2/ dans lequel
celui-ci a recommande' a` l'Assemble'e ge'ne'rale d'adopter le projet de
calendrier biennal des confe'rences et re'unions pour 1998 et 1999 qui
figure en annexe au rapport,
Se fe'licitant des mesures prises et des propositions formule'es
par le Gouvernement italien a` la suite de l'offre qu'il a faite
d'accueillir en juin 1998 une confe'rence sur la cre'ation d'une cour
criminelle internationale, y compris de la proposition tendant a` ce que
cette confe'rence se tienne du 15 juin au 17 juillet 1998 au Sie`ge de
l'Organisation des Nations Unies pour l'alimentation et l'agriculture a`
Rome,
1. Accepte avec une profonde gratitude l'offre ge'ne'reuse du
Gouvernement italien d'accueillir une confe'rence diplomatique de
ple'nipotentiaires sur la cre'ation d'une cour criminelle internationale;
2. Prie le Comite' pre'paratoire, pour la cre'ation d'une cour
criminelle internationale, de poursuivre ses travaux conforme'ment a` la
re'solution 51/207 et, a` la fin de ses sessions, de communiquer a` la
confe'rence diplomatique le texte d'un projet de convention portant
cre'ation d'une cour criminelle internationale e'tabli conforme'ment a` son
mandat;
3. De'cide que la Confe'rence de ple'nipotentiaires des
Nations Unies sur la cre'ation d'une cour criminelle internationale,
ouverte a` tous les E'tats Membres de l'Organisation des Nations Unies ou
membres des institutions spe'cialise'es ou de l'Agence internationale de
l'e'nergie atomique, se tiendra a` Rome du 15 juin au 17 juillet 1998, en
vue d'achever et d'adopter une convention portant cre'ation d'une cour
criminelle internationale et prie le Secre'taire ge'ne'ral d'inviter
lesdits E'tats a` la Confe'rence;
4. Prie le Secre'taire ge'ne'ral d'e'tablir le texte du projet
de re`glement inte'rieur de la Confe'rence et de le soumettre au Comite'
pre'paratoire, qui l'examinera et fera des recommandations a` la
Confe'rence a` son sujet, afin que la Confe'rence adopte ce re`glement
inte'rieur conforme'ment au Re`glement inte'rieur de l'Assemble'e
ge'ne'rale, et d'organiser des consultations sur l'organisation et les
me'thodes de travail de la Confe'rence, notamment son re`glement
inte'rieur, avant la convocation de la dernie`re session du Comite'
pre'paratoire;
5. Demande instamment que le plus grand nombre d'E'tats
participent aux travaux de la Confe'rence de fainternationale be'ne'ficie plus facilement d'un soutien universel;
6. Accueille avec satisfaction la de'cision prise par le
Secre'taire ge'ne'ral, conforme'ment a` la re'solution 51/207 de
l'Assemble'e ge'ne'rale, de cre'er un fonds d'affectation spe'ciale pour
permettre aux pays les moins avance's de participer aux travaux du Comite'
pre'paratoire et a` la Confe'rence, se fe'licite de la de'cision prise par
un certain nombre d'E'tats de verser des contributions au Fonds
d'affectation spe'ciale, et encourage les E'tats a` verser des
contributions volontaires a` ce fonds;
7. Prie le Secre'taire ge'ne'ral de cre'er un fonds
d'affectation spe'ciale pour les contributions volontaires destine' a`
financer la participation aux travaux du Comite' pre'paratoire et a` la
Confe'rence des pays en de'veloppement qui n'entrent pas dans la cate'gorie
des be'ne'ficiaires du fonds d'affectation spe'ciale vise's au paragraphe 6
et invite les E'tats a` verser des contributions volontaires a` ce fonds;
8. Prie aussi le Secre'taire ge'ne'ral d'inviter a` la
Confe'rence, en se fondant sur toutes les re'solutions applicables en la
matie`re/3/ les repre'sentants des organisations et d'autres entite's qui
ont reparticiper, en qualite' d'observateurs, a` ses sessions et a` ses travaux,
e'tant entendu que ces repre'sentants participeraient en cette qualite' a`
la Confe'rence, et d'inviter a` la Confe'rence, en qualite' d'observateurs,
les repre'sentants des organisations intergouvernementales re'gionales
inte'resse'es et d'autres organes internationaux inte'resse's, y compris
les Tribunaux pe'naux internationaux pour l'ex-Yougoslavie et pour le
Rwanda;
9. Prie en outre le Secre'taire ge'ne'ral d'inviter les
organisations non gouvernementales accre'dite'es par le Comite'
pre'paratoire compte ddu Conseil e'conomique et social et, en particulier, du lien que leurs
activite's pre'sentent avec les travaux de la Confe'rence, a` participer a`
la Confe'rence, en s'inspirant des orientations suivies par le Comite'
pre'paratoire, e'tant entendu que la participation a` la Confe'rence
signifie assister aux se'ances ple'nie`res et, a` moins que la Confe'rence
n'en de'cide autrement dans des circonstances particulie`res, aux se'ances
officielles de ses organes subsidiaires, a` l'exception du groupe de
re'daction, recevoir les documents officiels, mettre leur documentation a`
la disposition des de'le'gue's et faire des de'clarations en nombre limite'
aux se'ances d'ouverture ou de clconviendra, conforme'ment au re`glement inte'rieur qu'adoptera la
Confe'rence;
10. De'cide d'inscrire a` l'ordre du jour provisoire de sa
cinquante-troisie`me session la question intitule'e "Cre'ation d'une cour
criminelle internationale".

To: Recipients of icc-info This morning the UNGA Sixth Committee passed a resolution on the
establishment of an International Criminal Court deciding that
the United Nations Conference of Plenipotentiaries on the Establishment
of an International Criminal Court, open to all States Members of the
United Nations or members of specialized agencies or of the
International Atomic Energy Agency, shall be held in Rome from 15
June to 17 July 1998, with a view to finalizing and adopting a
convention on the establishment of such a court, and requests the
Secretary-General to invite those States to the Conference;
Operative paragraph 9 has language on the participation of NGOs at the
conference that will be of interest to many of you.

ESTABLISHMENT OF AN INTERNATIONAL CRIMINAL COURT
Draft resolution proposed by the Chairman of the
Sixth Committee
Establishment of an international criminal court
The General Assembly,
Recalling its resolutions 47/33 of 25 November 1992 and 48/31 of 9
December 1993,
Recalling also its resolutions 49/53 of 9 December 1994 and 50/46
of 11 December 1995,
Considering that, in its resolution 51/207 of 17 December 1996, it
decided to reaffirm the mandate of the Preparatory Committee on the
Establishment of an International Criminal Court, and decided also that the
Preparatory Committee shall meet from 11 to 21 February, 4 to 15 August and
1 to 12 December 1997, and from 16 March to 3 April 1998, in order to
complete the drafting of a widely acceptable consolidated text of a
convention, to be submitted to a diplomatic conference of plenipotentiaries,
Recalling that, in its resolution 51/207, it further decided that a
diplomatic conference of plenipotentiaries shall be held in 1998, with a
view to finalizing and adopting a convention on the establishment of an
international criminal court,
Recognizing the importance of concluding the work of the Conference
through the promotion of general agreement on matters of substance,
Noting that, at its 51st meeting, on 21 February 1997,/1/ the
Preparatory Committee welcomed the proposal by the Government of Italy to
hold the diplomatic conference in Rome and recommended to the General
Assembly that, pursuant to Assembly resolution 51/207 and after
consideration by the Committee on Conferences, a decision in accordance
with such proposal should be made when dealing with the necessary
arrangements for the conference, on the understanding that the organization
of the conference in Rome would proceed on the basis of the usual practice
concerning the funding of events of that kind taking place outside United
Nations Headquarters or the seat of other United Nations offices,
Noting also the report of the Committee on Conferences,/2/ in which
the Committee recommended to the General Assembly that it should adopt the
draft biennial calendar of conferences and meetings for 1998-1999 contained
in the annex to the report,
Welcoming the steps undertaken, and the suggestions made, by the
Government of Italy following its offer to host a conference on the
establishment of an international criminal court in June 1998, including
the proposal to hold such conference during the period from 15 June to 17
July 1998 at the headquarters of the Food and Agriculture Organization of
the United Nations in Rome,
1. Accepts with deep appreciation the generous offer of the
Government of Italy to act as host to the diplomatic conference of
plenipotentiaries on the establishment of an international criminal court;
2. Requests the Preparatory Committee on the Establishment of
an International Criminal Court to continue its work in accordance with
General Assembly resolution 51/207 and, at the end of its sessions, to
transmit to the conference the text of a draft convention on the
establishment of an international criminal court prepared in accordance
with its mandate;
3. Decides that the United Nations Conference of
Plenipotentiaries on the Establishment of an International Criminal Court,
open to all States Members of the United Nations or members of specialized
agencies or of the International Atomic Energy Agency, shall be held in
Rome from 15 June to 17 July 1998, with a view to finalizing and adopting a
convention on the establishment of such a court, and requests the
Secretary-General to invite those States to the Conference;
4. Requests the Secretary-General to prepare the text of the
draft rules of procedure of the Conference, to be submitted to the
Preparatory Committee for its consideration and recommendations to the
Conference, with a view to the adoption of such rules by the Conference in
accordance with the rules of procedure of the General Assembly, and to
provide for consultations on the organization and methods of work of the
Conference, including rules of procedure, prior to the convening of the
last session of the Preparatory Committee;
5. Urges participation in the Conference by the largest number
of States so as to promote universal support for an international criminal
court;
6. Notes with appreciation the decision by the
Secretary-General, pursuant to General Assembly resolution 51/207, to
establish a trust fund for the participation of the least developed
countries in the work of the Preparatory Committee and in the Conference,
welcomes the decision by a number of States to make contributions to the
Trust Fund, and encourages States to contribute voluntarily to the Fund;
7. Requests the Secretary-General to establish a trust fund
for voluntary contributions towards meeting the cost of participation in
the work of the Preparatory Committee and the Conference of those
developing countries not covered by the Trust Fund referred to in paragraph
6, and invites States to contribute voluntarily to this trust fund;
8. Also requests the Secretary-General to invite the
Conference representatives of organizations and other entities that have
received a standing invitation from the General Assembly pursuant to its
relevant resolutions /3/ to participate, in the capacity of observers, in
its sessions and work, on the understanding that such representatives would
participate in the Conference in that capacity; and to invite, as observers
to the Conference, representatives of interested regional intergovernmental
organizations and other interested international bodies, including the
International Tribunals for the former Yugoslavia and for Rwanda;
9. Further requests the Secretary-General to invite
non-governmental organizations, accredited by the Preparatory Committee
with due regard to the provisions of part VII of Economic and Social
Council resolution 1996/31 of 25 July 1996, and in particular to the
relevance of their activities to the work of the Conference, to participate
in the Conference, along the lines followed in the Preparatory Committee,
on the understanding that participation means attending meetings of its
plenary and, unless otherwise decided by the Conference in specific
situations, formal meetings of its subsidiary bodies except the drafting
group, receiving copies of the official documents, making available their
materials to delegates and addressing, through a limited number of their
representatives, its opening and/or closing sessions, as appropriate, in
accordance with the rules of procedure to be adopted by the Conference;
10. Decides to include in the provisional agenda of its
fifty-third session the item entitled "Establishment of an international
criminal court".

La Asamblea General,
Recordando sus resoluciones 47/33, de 25 de noviembre de 1992, y
48/31, de 9 de diciembre de 1993,
Recordando tambie'n sus resoluciones 49/53, de 9 de diciembre de
1994, y 50/46, de 11 de diciembre de 1995,
Considerando que, en su resolucio'n 51/207, de 17 de diciembre de
1996, decidio' reafirmar el mandato del Comite' Preparatorio sobre el
establecimiento de una corte penal internacional y decidio' tambie'n que el
Comite' Preparatorio se reuniese del 11 al 21 de febrero, del 4 al 15 de
agosto y del 1de 1998, con miras a terminar de redactar un texto consolidado de
aceptacio'n general de una convencio'n para presentarlo a la conferencia
diploma'tica de plenipotenciarios,
Recordando que, en su resolucio'n 51/207 decidio' asimismo que en
1998 se celebrase una conferencia diploma'tica de plenipotenciarios con
objeto de dar forma definitiva a una convencio'n sobre el establecimiento
de una corte penal internacional y adoptarla,
Reconociendo la importancia de concluir los trabajos de la
conferencia mediante la promocio'n de un acuerdo general sobre las
cuestiones de fondo,
Tomando nota de que, en su 51de 1997/1/, el Comite' Preparatorio acogio' con benepla'cito la propuesta
del Gobierno de Italia de celebrar en Roma la conferencia diploma'tica y
recomendo' a la Asamblea General que, de conformidad con la resolucio'n
51/207 de la Asamblea y tras su examen por el Comite' de Conferencias, se
adoptase una decisio'n conforme a dicha propuesta cuando se tomasen las
disposiciones necesarias para la conferencia, en el entendimiento de que la
organizacio'n de la conferencia en Roma se hari'a con arreglo a la
pra'ctica habitual respecto de la financiacio'n de este tipo de reuniones
fuera de la Sede de las Naciones Unidas o de la sede de otras oficinas de
las Naciones Unidas,
Tomando nota tambie'n del informe del Comite' de Conferencias/2/ en
el que e'ste recomendo' a la Asamblea General que aprobara el proyecto de
calendario bienal de conferencias y reuniones para 1998-1999 contenido en
el anexo de ese informe,
Acogiendo con benepla'cito las medidas adoptadas y las sugerencias
formuladas por el Gobierno de Italia tras su oferta de acoger una
conferencia sobre el establecimiento de una corte penal internacional en
junio de 1998, incluida la propuesta de que dicha conferencia se celebre
durante el peri'odo del 15 de junio al 17 de julio de 1998 en la sede de la
Organizacio'n de las Naciones Unidas para la Agricultura y la Alimentacio'n
en Roma,
1. Acepta con profundo agradecimiento la generosa oferta del
Gobierno de Italia de acoger la celebracio'n de la conferencia diploma'tica
de plenipotenciarios sobre el establecimiento de una corte penal
internacional;
2. Pide al Comite' Preparatorio sobre el Establecimiento de
una Corte Penal Internacional que prosiga sus trabajos de conformidad con
la resolucio'n 51/207 de la Asamblea General y que, al concluir sus
peri'odos de sesiones, transmita a la conferencia el texto de un proyecto
de convencio'n sobre el establecimiento de una corte penal internacional
preparado de conformidad con su mandato;
3. Decide que la Conferencia de Plenipotenciarios de las
Naciones Unidas sobre el Establecimiento de una Corte Penal Internacional,
abierta a todos los Estados Miembros de las Naciones Unidas o miembros de
sus organismos especializados o del Organismo Internacional de Energi'a
Ato'mica, se celebre del 15 de junio al 17 de julio de 1998 en Roma, a fin
de concluir y adoptar una convencio'n sobre el establecimiento de dicha
corte; y pide que invite a esos Estados a participar en la Conferencia;
4. Pide al Secretario General que prepare el texto del
proyecto de reglamento de la conferencia, que se presentara' al Comite'
Preparatorio para que lo examine y formule sus recomendaciones a la
Conferencia, a fin de que e'sta apruebe dicho reglamento de conformidad con
el Reglamento de la Asamblea General, y que prevea la celebracio'n de
consultas sobre la organizacio'n y los me'todos de trabajo de la
conferencia, incluido su reglamento, antes de que se celebre el u'ltimo
peri'odo de sesiones del Comite' Preparatorio;
5. Insta a que el mayor nu'mero posible de Estados participen
en la conferencia para promover el apoyo universal a la corte penal
internacional;
6. Toma nota con aprecio de la decisio'n del Secretario
General, en cumplimiento de la resolucio'n 51/207 de la Asamblea General,
de establecer un fondo fiduciario para la participacio'n de los pai'ses
menos adelantados en los trabajos del Comite' Preparatorio y en la
Conferencia; celebra la decisio'n de algunos Estados de hacer
contribuciones al fondo fiduciario y alienta a los Estados a que hagan
contribuciones voluntarias al fondo;
7. Pide al Secretario General que establezca un fondo
fiduciario de contribuciones voluntarias para hacer frente al costo de la
participacio'n en los trabajos del Comite' Preparatorio y de la Conferencia
de los pai'ses en desarrollo que no puedan recurrir al Fondo Fiduciario a
que se hace referencia en el pa'rrafo 6, e invita a los Estados a que hagan
contribuciones voluntarias a ese fondo fiduciario;
8. Pide tambie'n al Secretario General que, teniendo en cuenta
todas las resoluciones pertinentes/3/ invite a participar en la Conferencia
a representantes de organizaciones y otras entidades que hayan recibido una
invitacio'n permanente de la Asamblea General a participar, en calidad de
observadores, en sus peri'odos
de sesiones y en sus trabajos, en el entendimiento de que dichos
representantes participara'n en la Conferencia a ese ti'tulo; y que invite,
en calidad de observadores en la Conferencia, a representantes de las
organizaciones intergubernamentales regionales interesadas y otros o'rganos
internacionales interesados, incluidos los Tribunales Internacionales para
la ex Yugoslavia y para Rwanda;
9. Pide adema's al Secretario General que invite a las
organizaciones no gubernamentales acreditadas por el Comite' Preparatorio,
teniendo debidamente en cuenta las disposiciones de la parte VII de la
resolucio'n 1996/31 del Consejo Econo'mico y Social de 25 de julio de 1996
y en particular la pertinencia de sus actividades para la labor de la
Conferencia, a que participen en la Conferencia a tenor de la pra'ctica
seguida en el Comite' Preparatorio, en el entendimiento de que participar
quiere decir asistir a las sesiones plenarias y, salvo que la Conferencia
decida otra cosa en situaciones concretas, a las sesiones oficiales de sus
o'rganos subsidiarios, excepto el grupo de redaccio'n, recibir ejemplares
de los documentos oficiales, poner su documentacio'n a la disposicio'n de
los delegados e intervenir, mediante un nu'mero limitado de sus
representantes, en las sesiones de apertura y/o de clausura, segu'n
proceda, de conformidad con el reglamento que apruebe la Conferencia;
10. Decide incluir en el programa provisional de su
quincuage'simo tercer peri'odo de sesiones el tema titulado
"Establecimiento de una corte penal internacional".
