Draft document of the RMDSz-UDMR (Democratic Union of Hungarian from Romania) - March-April 1993

In consequence of the ethnical conflict organized by the Romanian extremists on the 19 20 March 1990, 6 persons died, several suffered serious physical injuries or permanent insufficiencies.

In consequence of the attack against the UDMR Mures headquarters on the 19 March 1990 only victims with Hungarian nationality suffered physical injuries and needed medical care. On the 20 March, till 20.30 hour the great majority of the victims referred to hospital were also Hungarians and from the 5 death, 3 were also Hungarian.

After the 20 March 1990 the Criminal Investigation Organe (Police and Prosecutor's department) started to call to account and send to trial the guilty ones. UDMR and the citizens of Hungarian nationality informed and reported proofs against the organizers and executants of the Pogrom from Tirgu Mures. To the great majority of them we became the resolution of non begining of the legal investigation. Penal trials were started against the Hungarian and GYPSY suspects and accused and only in 2 cases against Rumanian suspects. Through the pronounced penal decisions to the penalty of prison were sentenced exclusively Hungarians and Gypsies. Totally 44 persons were sentenced to liberty depriving punishments including 66 years of Prison (annex nr.1).

The most unjust decision was pronounced in the file concerning the accused Cseresznyes Pal and Barabas Erno. After all that Cseresznyes Pal was a simple participant at the Peaceful Hungarian demonstration from the 20 March. Although he uas in a group of Hungarian demonstrators attacked violently by the Romanian Peasants brought from the Gurghiu Valley. Although he kicked only once the victim Mihai Cofariu (from which the legal medical examination made in the case established that it could not put in danger the victims life). Although he did not know any of the others who kicked the victim and he had no agreement with them, the law courts from Romania established his guilt and sentenced him to 10 years prison for committing the crime of especially heinous attempted murder and disturbing the public silence !!!

We consider the decisions unlawful, thoroughly amoral, made with the grave violation of the fundamental human rights. Untill Cseresznyes Pal was sentenced for a single kick to 10 years prison, a fact teared from the context of a fight with more than 10.000 participants, we consider that the decisions have a leap political character. In spite of that the facts noted in the judicial decision in fond are in obvious contradiction with the evolution of the events established by the Helsinki Council and even by the Report of Romania's Parliament.

We are deeply concerned of the fact that after more then 3 years from the events from Tirgu Mures the justice could not pronounce a just, equitable decision.

We consider that the responsibility concern entirely the governamental coalition which used all the propaganda instruments and the influences for prove through judicial decision that the guilty in the events of Tirgu Mures are the Hungarians and Ggpsy. The Latins said FIAT JUSTITIA PEREAT MUNDUS. We ask less: only justice.
