Permanent tribunal

Draft motion

on: "Establishment of a permanent international penal tribunal".

Whereas:

- a first nucleus of international justice must ce created to act upon those who commit cruel and intolerable crimes;

- the international community is still unable to act unilaterally in international crises;

- it is imperative for the international community to show a common consideration of human dignity, without any connivance or complicity with the authors of the worst crimes;

- an absolute neutrality and objectivity must be respected in the exercise of international justice, whatever the part of the world and the state in which the international crimes are committed:

- Nuremberg was the invention of the victorious powers, and the Tribunal for crimes in the former Yugoslavia represents the only work of international justice of the Security Council;

- no sustainable development can be imagined for future generations in a world without justice;

- discussions have been under way for many years on the development of a code of crimes against peace and the safety of humanity (the project of a major international penal code);

- the General Assembly in 1993 charged the international law commission with the urgent task of drafting a statute in order to establish a permanent international court in the coming assembly of 1994;

binds the government:

- to undertake all necessary institutional and diplomatic initiatives in order to allow the General Assembly, in its 49th session, to solve the political problems that still remain and to decide the establishment of a permanent international tribunal.
