SLOVENIA: International Criminal Court

... Mr Chairman,

The Slovenian delegation supports the establishment of an international criminal court on the basis of a Statute as its constituent treaty. As it follows from many provisions of the draft Statute, a Court, asnow envisaged, will be closely linked to the UN. Therefore, its institutional arrangement with the UN will be inevitable. My delegation is in favour of the solution that would bring the Court into the relationship with the Un by means of an agreement between the Court and the UN as will obviously be the case in respect of the Tribunal for the Law of the Sea. This solution would not require an amendment of the UN charter and would best preserve the autonomous character of the future Court...

... As regards the applicable penalties, our delegation notes with satisfaction that the present Article 47 on applicable penalties have been improved so that it contains besides the term of life imprisonment also a provision on an imprisonment for a specified number of years. Namely, in Slovenia the capital punishment is constitutionally prohibited and the 20 year-term of imprisonment as the maximum term is foreseen for the most serious crimes.

Mr. Chairman,

The Slovenian delegation too believes that there is an eminent need in the international community to establish a permanent international criminal court and that an international conference of plenipotentiaries be convened respectively.
