Yesterday, 13.12.1994 the Counsil of the State Duma has confirmed theagenda for the Plenary session of the State Duma for 14th of december.
It means that the debate on the draft bill "On alternative civilian
service" will be held in the first part of the day as it has been
scheduled before.
The latest text of the draft bill "On alternative civilian service"
differs from that in AGORA (Conference radical party, number 4006)be-
cause working group of the State Duma has changed it since the time
when it has been translated by Moscow office of RP.May be that is the
cause of the different opinions amoung radicals on that draft bill
(I'd like to mention again that two radicals - A.Kalinin and M.Ivanjan
are officially members of the Parlaments working group on that draft
bill).Now I'll try to clear our position.
1.N.Khramov wrote in AGORA (Conference Radical Party, text number
4786) following:"I would like to stress again that this draft bill is
yet far from being really democratic. First of all because of provided
in this draft bill possibility for Military Recruitment Office to es-
tablish autonomously whose convictions permit to obtain alternative
civilian service and whose not..."
Working group inist on civil character of the Enlistment Commission
which is not subordinate to any military institution.
Article 9 (draft bill "On alternative civilian service")
"...After the Enlistment Commission is formed by the local authority
all the registered conscientious objection applications must be sub-
mitted to the Enlistment Commission within a period of 3 days."
Article 10
"Enlistment Commission reviews an application submitted by a citizen
and takes reasonable decision upon it. Enlistment Commission session
is held openly..."
The law "On military duty and military service" adopted in 1992 by the
Supreme Soviet:
Article 24 "For the organisation and realisation of the conscription
of the citizens for military service the local authority creates an
Enlistment Commission in each region or city. This Commission consists
of following members:
- vice-president of the local administration (head of the Commission),
- local military Commissioner (vice-president of the Commission),
- representative of the local legislative body,
- secretary,
- phisician,
- representative from the local body on internal affairs,
- representative fron the local body on education.
The structure of the Enlistment Commission may include representatives
of different enterprises, institutions and organisations."
Article 25
"... The Enlistment Commission must take one of the following decisi-
ons;about the conscription to the military serviceabout the SENDING TO
THE ALTERNATIVE SERVICE..."(This law is in power since 1992.)
2. N.Khramov: "No examination for belief must be provided."
Working group: The form of the application of the citizen is a state-
ment (where the reasons of citizen's conscientious objection are moti-
vated). The Enlistment Commission is empowered to refuse one's appli-
cation for being assigned to alternative civilian service in accordan-
ce within the reasons (article 12 "The reasons for refusal in substi-
tution of military service to alternative civilian service").In the
case when this Enlistment Commission has doubts about the sincerity of
the citizen's convictions written in the application it makes additio-
nal inquiries about this citizen and IT MAY PROOF the absence of the
conscientious convictions. If this citizen doesn't agree with the de-
cision of the Enlistment Commission he has the right to write an app-
lication to the court.
3. About the RP/CSM memorandum: The proposals fixed there will be dis-
cussed by the working group after the first reading of this draft bill
along with the proposals from other public organisations (This memo-
randum was given to the working group only on 18.11.94. The latest
text of the draft bill is dated 15.11.94. It means that we can't chan-
ge the draft bill till the afterfirstreading time). Today I'll write
about the results of the debates on the draft bill "On alternative si-
vilian service". I have an unofficial and not confirmed information
that at least 3 fractions of State Duma will be voting in favour.
