To the attention of the Tverskoj interdistrict public prosecutor of Moscow
Dear public Prosecutor:
October 16, this year the Transnational Radical Party carried out at a building of State Duma a demonstration in support of the international initiative for indictment Serbian president Slobodan Milosevic by the Hague tribunal for war crimes, crimes against mankind and genocide.
Organizers of the action (Alla Asaeva, Anna Zajceva and me) according to the "Provisional rules on the notification procedure of bodies of the executive authority of Moscow about realization of meetings, street processions, demonstrations and picketing on the streets, squares and in other open public places of the City" in time have submitted the notice in Prefecture of the Central administrative district.
October 5, 1998 by the CAD prefect Mr. A. Muzykantskij the order under registration number 2879r was issued, it was recommended with which, in particular,:
"1. To give the representatives of the Transnational Radical Party a place at the building of the State Duma (Okhotny rjad 1) on October 14 and 16, 1998 from 9.00 till 12.00 for realization of meetings with amount of the participants 20 persons with the purpose, specified in the notice, without creation of obstacles for entrance and exit from the building, for movement of transport and pedestrians. <...>
3. District UVD (A. V. Kulikov) together with "Tverskoj" district Uprava (A. V. Litoshin) to assist the organizers of the action in maintenance of the public order, in case of its infringement to inform the Prefecture (I. I. Artanov).
4. The control of performance of the present order to assign on vice prefect of the CAD Mr. I. I. Artanov, chief district UVD A. V. Kulikov and head of "Tverskoj" Uprava Mr. A. V. Litoshin"
When the organizers arrived on the place of demonstration, there has not appeared none of the above mentioned officials. Instead of them the place allocated to us for demonstration was occupied by crowd approximately in hundred persons with red flags and slogans in support of the public anti-semitic statements made by the member of State Duma Albert Makashov. Deputy Makashov together with the assistant of a member of parliament Mr. I. Anpilov also were among the people which have autocratically occupied the place, allocated to us.
I have addressed to the employees of militia with the request to explain, how item 1 of the above mentioned order N 2979r from October 5, 1998 should be carried out in the current circumstances. The militiamen could nothing explain to me, referring on absence of "heads".
We have tried to begin our manifestation, however the Makashov's and Anpilov's supporters have interfered, showering us by the anti-semitic insults, threats of physical violence and shouts "Jews, be removed in Israel!". Konstantin Borovoj, member of the State Duma taking part in our manifestation, has subjected to especially furious attacks. The hooligans tore our two posters with inscriptions "Freedom for Kosovo, democracy for Serbia" and "Protect the Serbian brothers against national bolshevist regime of Milosevic".
Despite of my numerous calls to the employees of militia, they have not undertaken any steps for restoration of the public order and maintenance of normal realization of demonstration according to the order of the CAD prefect. Moreover, the not presented himself employee of militia in the civilian cloth (apparently, from the State Duma guardian unit) has required of us to not use a megaphone, threatening otherwise to "remove us" (!).
I regard all this not only as rough neglect by the officials their duties having place both from side of the workers of militia (in particular, representative of the District UVD Mr. Kulikov), and from side of the head of the "Tverskoj" Uprava Mr. Litoshin, as well as from side of the vice prefect of the CAD Mr. Artanov. I regard it also as an administrative offence stipulated by Art. 166-1 Comma 1 of the Administrative Code of the RSFSR which have resulted in rough infringement of the right of citizens "to be going peacefully, without the weapon to carry out assemblies, meetings and demonstrations, procession and picketing", guaranteed by Art. 31 of the Constitution of Russian Federation.
I ask you, according to the law, to consider the given statement, to check up its validity and after establishment of the facts of infringement of the law to arrange their elimination and restoration of the our violated rights.
I request you also to inform me on the measures, accepted by you, within the terms, established by law.
