DECLARATION OF OLIVIER DUPUIS AND GIANFRANCO DELL'ALBA, MEMBERS OF EUROPEAN PARLIAMENT (ERA)

Strasbourg, 6 May, 1999. In its resolution on Kosovo, the European Parliament has accepted the radical amendment affirming that "the massive deportation of hundreds of thousands Kosovars constitutes, besides numerous violations committed, a sufficient basis - in accordance with the Statute of the International Criminal Tribunal for the former Yugoslavia and particularly with its Articles 2, 3, 4, 5 and 7 - for the immediate indictment of the highest political and military authorities of Belgrade, beginning with Slobodan Milosevic".

"With this resolution, the European Parliament launches a clear signal to all those who continue hide behind arguments that the Tribunal does not yet possess the material elements to indict those most responsible for the crimes committed in Kosovo. This argument is nothing else that an alibi to do nothing. As it would have been an alibi not to indict Hitler under the pretext that all the responsibles for the extermination camps had not been indentified. The deportation of more than 800.000 persons - an uncontested fact (who could contest it?) constitutes indisputably, according to the Statute of the Tribunal, a crime against humanity. And enables therefore Mrs. Arbour to indict immediately Mr. Milosevic.
