Russia/Luzhkov: text of the Appeal to the Prosecutor General

To the acting General Prosecutor

of the Russian Federation

APPEAL

Esteemed Mr. Prosecutor,

We ask You to carry out a prosecutor's control of the anticonstitutional and illegal actions committed (and still being committed) by the Mayor of Moscow Yurii M. Luzhkov; the actions that have drawn serious and large-scale violation of rights and legal interests of the citizens. The case in point is the unlawful Decree 1007 of the Mayor of Moscow, of September 13, 1999, "On the urgent measures for providing the order of registration for the citizens that stay in Moscow temporarily" and the actions carried out by Moscow authorities in order to realize this Decree.

This Decree orders the Moscow militia to "register in three days all over again all the citizens staying in Moscow since January 1, 1999, and provide them with the new registration certificates. Declare to everybody the request to register themselves at the Internal Affairs bodies of the place they are staying at within three days" This request is unlawful, because the "Rules of registration and of sticking off the register in the place of stay and the place of residence for Russian Federation citizens", approved with the Decree of the government 713 on July 17, 1995, do not commit the citizens that have already declared their registration to do it once again. The request to confirm the registration two times a year (earlier included in the Rules) has been abolished on February 2, 1998 with a decision of the Constitutional Court which has pointed out that such a request "limits the constitutional rights of citizens to the freedom of choosing the place of stay and residence".

The Mayor's Decree also requests "to provide the examination of the questions concerning the registration of citizens that stay in Moscow temporarily. It is necessary to clear the goal of their staying in Moscow." This request is unlawful too, because the Registration Rules do not provide for the case of a refused registration. A citizen just has to make an application for the registration and present a document prooving that the owner of the apartment agrees that he would live on his territory. However, according to the information of the media that refer to the Head of the Passport Direction of Moscow Militia Mr. Serov, the applications of 16.000 citizens have been refused since the start of the "re-registration".

The Mayor also commits the militia bodies "to take the arrangements provided by the law to those who violate these Rules, even to evict hem back to their place of residence, if necessary". Their request is unlawful, because "to evict them to their place of residence" is not provided by any legislation act in Russia, including the actual Administrative Code of the RSFSR; that in Art. 178 provides the maximum punishment for staying in a place without registration - a 25 rubles fine. However, according to the media that refer to the same militia officer, 517 people "have already been evicted" from Moscow.

It is evident that the actions of the Moscow Mayor Yurii M. Luzhkov exceed his authorities and involve serious large-scale violation of rights and lawful interests of the citizens. The militia carries out his Decree with violence, arms and special equipment. This constitutes a corpus delicti, provided in Art. 285.3 of the Russian Criminal Code ("Exceeding office authorities") and is to be punished with an imprisonment of 3 - 10 years; one may not fill certain positions and be involved in certain activities for the term of 3 years as well).

Thus, we ask You to examine the possibility of instituting criminal proceedings against Yu.M. Luzhkov, according to Art. 285..3, and to answer our collective appeal.
