(Moscow, July 8 and 9, 1994)The Enlarged Meeting of the members of the General Council of Radical party from CIS and Baltic states, that was held in Moscow on July 8-9, 1994, considers the problems detailed thereafter to be of essential importance.
A. Firmly believing, that death penalty is not only the blatant violation of fundamental human rights (first of all, the most important one as a right to live); the institute of death penalty causes essential threatening to the State of Law, that which is in the process of foundation nowadays in all the post-totalitarian societies. Due to the fact that many of ex-Soviet are revising their constitutions, the death penalty problem is of great importance.
In connection with that, the Meeting brings attention to the positive experience of the Georgian Parliament, which Constitutional Commission has included the article on the abolition of death penalty into the Draft Constitution that was prepared for debates now. The Meeting appeals to the members of Radical party, members of national parliaments, and governing bodies of RP to organize the campaign for preservation of mentioned article into the Draft Constitution of Georgia, if necessary, during next weeks and months.
The Enlarged Meeting also appeals to continue and to enforce the pending campaign against death penalty in Moldova, for the Parliament of Moldova will also discuss the project of the new Constitution this year.
It is necessary to pay attention to the similar situation in Armenia, for the project of Constitution of Armenia includes the special article on inviolability of human life, that permits an interpretation in abolitionist sense and can become the start-point for an abolitionist campaign in Armenia.
The Meeting considers necessary to emphasize an evident danger relating to further discussion of the new Criminal Code of Ukraine in Autumn, since not the Draft Code limits the field of application of death penalty to the minimum, but even extends it. In connection with that, the Enlarged Meeting appeals to carry out an appropriate transnational initiative towards Supreme Rada of Ukraine.
As for the situation in Russia, the Enlarged Meeting considers it necessary to concentrate on obtaining the permanent and stable character of the death penalty moratorium, that was established de facto by President Yeltsin. It is expedient to organize an appeal of outstanding figures of politics, science, and culture to President Yeltsin and Russian Federal Assembly with a demand of permanence and stability of the moratorium and of abolition of death penalty in Russia de jure during next several years.
The Meeting also pays attention to the importance of efforts on the level of international organizations for creating the universal death penalty moratorium. In connection with that, it is necessary to support broadly the initiative of the Italian government, that will include the question of establishment of such moratorium to the agenda of future session of UN General Assembly and will support it by adoptions of the appropriate resolutions by those parliaments, that include members or adherents of Radical party.
B. As to the question on the International Tribunal on war crimes in ex-Yugoslavia, the Enlarged Meeting turns attention to attempts (especially of permanent member states of UN Security Council) to block up work of the Tribunal by any means, putting new and newer obstacles in the way of its efficient activity, the last of that being the impossibility to start work without General Prosecutor. In connection with that, a new transnational mobilization is necessary to obtain as soon as possible the appointment of the new General Prosecutor by the UN Security Council.
It is also necessary to organize actions to provoke the Tribunal on crimes in ex-Yugoslavia not to investigate only cases of direct executors of crimes, but also to bring organizers of the "ethnic cleaning" policy to trial.
C. On the Permanent International Court on war crimes and crimes against humanity, the Enlarged Meeting expresses satisfaction with last news from Geneva. According to them, the International Law Committee on international law will soon finish its work with the Statute. In case if in the closest future the news will be confirmed, that will mean that the UN General Assembly will get a possibility (theoretically speaking, at least) to discuss and to adopt the Statute during its next session in Autumn of that year. However, that will also mean, that members of Radical party will have to organize campaign of pressure of governments of their countries in a short time, including adoption of appropriate documents in parliaments, to provide a real possibility for UN General Assembly to discuss and to adopt the Statute of the Permanent international court before the end of this year and to establish it in next year 1995, coinciding with the 50th anniversary of UN.
The Meeting also turns attention on necessity of unification to support a principally new sovranational juridical institution, that is the Permanent international court, and different social forces and separate people, and suggests to ensure efforts for enlistment to the international committee "There Is No Peace Without Justice", that was established in Spring of that year, for enlistment of parliamentarians, mayors, writers, scientists, and other outstanding figures, and also of citizens of CIS and Baltic countries.
D. The Enlarged Meeting turn attention to the fact, that Russian Federation is the only republic of ex-USSR, where the mechanism of realization of the right of citizens to refuse military service by means conscience is still absent. The Enlarged Meeting considers it necessary to restart campaign for adoption of the Law on alternative civic service by State Duma.
It is also necessary to restart debates on questions of anti-militarism, pacifism and non-violation, of collaboration and relations with all anti-militarist groups, especially in view of the fact, that after the crush of Berlin Wall and the disappearance of bipolar split of the world by the line East - West, peace movements and groups experience crisis and stagnation, while the necessity of solid anti-militarist front is no doubt, especially considering military, fascist and Nazi threat, derived from many post-totalitarian countries.
E. The Enlarged Meeting considers it necessary to ensure efforts of Radical party in its struggle for the new safe energy policy. In particular, it is necessary to put forward the question of urgent closing of dangerous atomic power plants in countries of ex-USSR, about consequences of incidents and safe storage of nuclear waste. In connection with that, the refusal of the Ukrainian government to close Chernobyl nuclear power plant in spite of international pressure made in that direction, provides a great worry. It is necessary also to draw the attention of the international environmental organizations to the document prepared by the Commission on the questions of environment and natural resources of the Supreme Council of the Republic of Armenia, that which speaks about the renewing of work of the Armenian nuclear power plant, and also process the ways for developing the alternative energy sources in Armenia.
F. The Meeting expresses its concern about the situation with the rights of people without citizenship in Latvia and Estonia and urges the Radical Party to hold the conference on that issue in Riga within Autumn this year.
G. The Meeting ascertains the obvious lack of efforts in CIS and Baltia on formation of membership for year 1994 and appeals all members of Radical party to enlist new members in local places more actively. Beside of the Transnational bulletin, that is issued science April of this year, that is important as the only mean of communication and information (considering poorly developed and inaccessible computer networks in comparison with Western countries and the lack of an instrument like Radio Radicale), the Enlarged Meeting suggests such instruments of Radical party enlistment campaign as a series of opened Assemblies of Radical party, that should be carried out in different cities during next several months, intending to increase membership in countries of ex-USSR up to the level of last year.
H. The Meeting considers as necessary to strengthen the efforts to propagate in the mass media of CIS and Baltic states the activity of the Radical Party.
