EP/question time/incrimination of Slobodan Milosevic: oral question and response of the Council

ORAL QUESTION H-0957/98

Question time, November '98 session presented according to Art. 41 of the rules by Olivier Dupuis to the Concil.

Object: Incrimination of President Milosevic

At the worst moment of the war in Bosnia, the Union, or rather its Member States have not, for formalistic contestable, and indeed contested, reasons - the absence of continuity in the command structure - and, without doubt, less confessable reasons, have politically supported the incrimination of Mr. Milosevic as they did for Mr. Maldic and Mr. Karadzic. Today, the policy carried out in Kosovo is under the direct responsibility of Belgrade and, therefore, of Mr. Milosevic. It is for instance incontestable that, within the frame of this policy, crimes against humanity and war crimes have been committed in Kosovo. Does the Council think that, as the European Parliament has stated on October 8, 1998, that the general conditions could allow its support, as well as that of the Member States, for the indictment of Milosevic before the ICTY?

Response to the oral question 15. (H-0957/98) by Olivier Dupuis

The Council fully shares the point of view of the honorable member that it is in Belgrade that lies the main responsibilities of the Kosovo crisis.

Furthermore, the Council reminds that it is the ICTY Prosecutor's opinion that the situation in Kosovo constitutes an armed conflict, which follows under the Tribunal jurisdiction.

The Council has strongly condemned those culpable for the atrocities committed in Kosovo and has invited the authorities of Belgrade to investigate, identify and punish the responsible. The Council has called on all interested parties to fully cooperate with the ICTY in the researches of alleged violations relevant to the Tribunal's jurisdiction.

In this regard, on October 5, 1998, the Council decided that a team of experts of the EU, constituted of specialists from Finland and others, visit the region as soon as the sites will be identified, the security of the mission granted and the all technical problems solved.

The Council is also pleased to note that the atrocities committed in Kosovo have been exploited for propaganda purposes by both parties and that, even if the majority of them are attributed to Serbs (Special police and paramilitary forces, etc.), it is too soon to draw final and objective conclusions on the matter. The result of the investigating team of EU experts may have political as well as juridical implications that may very well allow the indictment by the ICTY.
