United Nations Conference on an International Code of Conduct on the Transfer of Technology
The General Assembly,
Recalling the Declaration and the Programme of Action on the Establishment of a New International Economic Order, contained in its resolutions 3201 (S-VI) and 3202 (S-VI) of 1 May 1974, the Charter of Economic Rights and Duties of States, contained in its resolution 3281 (XXIX) of 12 December 1974, and its resolution 3362 (S-VII) of 16 September 1975 on development and international economic co-operation,
Recalling also its resolution 35/56 of 5 December 1980, containing the International Development Strategy for the Third United Nations Development Decade,
Recalling further its resolutions 32/188 of 19 December 1977, 34/195 of 19 December 1979 and 35/60 of 5 December 1980 on an international code of conduct on the transfer of technology,
Noting with concern that the fourth session of the United Nations Conference on an International Code of Conduct on the Transfer of Technology did not conclude the work on the adoption of a code of conduct on the transfer of technology, and noting particularly the lack of progress made in reaching agreement on several issues outstanding in the draft code of conduct,
1. Takes note of the progress achieved in the negotiations on the draft international code of conduct on the transfer of technology;
2. Recognizes the importance of the unresolved issues and the need
to reach agreement on them;
3. Decides to establish, as a special measure to accelerate the finalization of the code, an interim committee of the United Nations Conference on an International Code of Conduct on the Transfer of Technology to consider and seek solutions to the outstanding issues and make proposals thereon to the Conference at its fifth session;
4. Decides also that the interim committee shall be open for the participation of all States members of the United Nations Conference on Trade and Development and shall meet as necessary within the four weeks allocated to it, and that its rules of procedure shall be those of the Conference;
5. Requests the Secretary-General of the United Nations Conference on Trade and Development to convene the interim committee in the first quarter of 1982 and to submit to the committee all appropriate documentation to assist it in its work;
6. Invites the Secretary-General of the United Nations Conference on Trade and Development to follow closely the progress of work in the interim committee, with a view to convening the Conference as soon as practicable and preferably not later than the last quarter
of 1982 or the first quarter of 1983.
