Amendment to the Commission proposal for a Council directive on the approximation of the laws of the Member States relating to the compulsory use of safety belts in vehicles of less than 3.5 tonnes

5a. After the last Article the following new article is added:
'This directive shall not prevent the Member States from introducing or applying more stringent legal or administrative measures concerning the use of safety belts.'

LEGISLATIVE RESOLUTION
embodying the opinion of the European Parliamenton on the amendment to the Commission proposal for a Council directive on the approximation of the laws of the Member States relating to the compulsory use of safety belts in vehicles of less than 3.5 tonnes
The European Parliament,
- having regard to the amendment to the Commission proposal to the Council (COM(90) 0524)OJ No. C 308, 8.12.1990, p. 11,
- having been consulted by the Council pursuant to Article 75 of the EEC Treaty (C3-0041/91),
- having regard to the report of the Committee on Transport and Tourism
(A3-0191/91),
1. Approves the Commission proposal subject to Parliament's amendments and in accordance with the vote thereon;
2. Calls on the Commission to amend its proposal accordingly, pursuant to Article 149(3) of the EEC Treaty;
3. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament;
4. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;
5. Instructs its President to forward this opinion to the Council and Commission.
