IRAQ'S FAILURE TO RESPECT THE UNITED NATIONS' RESOLUTIONS

Joint resolution replacing B3-1171, 1176, 1191, 1201, 1205 and 1206/91

The European Parliament,

A. recalling the UN Security Council resolutions on the situation in the Gulf and, in particular, Resolutions 687 and 688 on the ceasefire and the situation in Iraq after the Gulf war,

B. concerned at information that Iraq may have a large nuclear arsenal, and whereas it is very easy to switch from civilian to military uses of nuclear power,

C. whereas the Iraqi authorities have not yet complied with the UN resolutions; gravely concerned by the attempts on 28 June to prevent, by force, the inspection of equipment that could be used for the manufacture of nuclear weapons which officials of the International Atomic Energy Agency (IAEA) were attempting to carry out in accordance with the mandate of the Security Council,

D. concerned at the post-war situation in Iraq, in particular with regard to internal democracy and respect for human rights, and at the economic situation and the health conditions of the people, particularly the Kurdish and Shiite minorities in the north and south-east of the country,

E. having regard to the declaration of the Twelve of 29 June 1991 on the situation in Iraq,

F. recalling its previous resolutions on the Gulf crisis and, in particular, its resolution of 14 March 1991 on the situation in the Gulf,

1. Is disturbed at the fate of the civilian population of Iraq, notably the Kurds and Shiites who are the victims of brutal repression, and calls for all possible measures to be taken to prevent selective assassination, arrests and other crimes against individuals by the Iraqi authorities;

2. Calls on the Allies not to withdraw their armed forces from the protective zone until the safety of the Kurdish refugees who have returned to Iraq is guaranteed by the United Nations;

3. Recommends that all post-war management, and in particular the supervision of Iraq's implementation of UN resolutions, should be entrusted to the UN Secretary-General and Security Council;

4. Calls on the Iraqi authorities to comply with all the provisions of UN Security Council Resolutions 687 and 688, in particular with regard to the establishment of democracy through the holding of free elections as soon as possible, so that relations may quickly be restored with Iraq in order to enable the many problems cited in the Ahtisaari report (doc. S/22366 of the Security Council of 29 March 1991) to be tackled and to avoid the 'new catastrophe - including epidemic and famine' feared by the report;

5. Calls on the Iraqi authorities to comply fully with the UN Security Council resolutions, in particular with regard to freedom of access for UN and IAEA experts to nuclear sites, power stations and installations;

6. Calls on the Iraqi Government to do everything possible to improve the living conditions of the Iraqi people as soon as possible;

7. Instructs its President to forward this resolution to the Commission, the Council, European Political Cooperation, the Iraqi authorities and the Secretary-General of the UN.
