(b) Joint resolution replacing B3-1152, 1172 and 1184/91
The European Parliament,
A. having regard to its record of commitment to human rights and fundamental freedoms throughout the world,
B. whereas Abdel Moumen Diouri, a Moroccan political refugee, has been deported to Gabon by the French authorities,
C. whereas he was expelled from France under the exceptional emergency procedure, which rules out any possibility of appeal before expulsion,
D. believing that the reasons given by the French Government for its deportation order are unsatisfactory,
E. concerned at the request by Morocco to the Gabon authorities for the extradition of Abdel Moumen Diouri,
F. having regard to the rejection by Switzerland of Mr Diouri's request for temporary residence on 4 July 1991,
1. Is disturbed at the deportation of a political refugee to a country which had previously maintained very close relations with the state which he had reason to fear would persecute him;
2. Deplores the violation, for reasons of state, of the right of asylum, the recognition and guarantee of which must be one of the political principles of the Community;
3. Calls on:
- the French Government to review the measure taken against Abdel Moumen Diouri,
- the President of Gabon to ensure that his personal safety is guaranteed,
- the Office of the United Nations High Commissioner for Refugees to take special care to ensure that Mr Diouri is not extradited to Morocco;
4. Instructs its President to forward this resolution to the Commission, the Council, EPC, the French Government, the Office of the UN High Commissioner for Refugees and the President of Gabon.
