Resolution on the draft legislative programme for 1993
The European Parliament,
-having regard to Rule 29a of its Rules of Procedure,
-having regard to the draft legislative programmes for 1993 (COM(93)0043),
-noting the priorities established by the Council Presidency for the first six months of 1993,
-having regard to its resolution of 10 February 1993 on the presentation and programme of the new Commission,
A.whereas, in the interests of both citizens and institutions, the Community decision-making process should be as effective and transparent as possible,
B.whereas one means of achieving transparency, proposed in its resolution of 14 October 1992 on the state of European Union and ratification of the Maastricht Treaty and endorsed by the Edinburgh European Council, is through interinstitutional legislative programming,
C.pending the entry into force of the Treaty on Union expected in the course of 1993,
D.noting the projects for legislation still being discussed and the measures that the Commission will present in the coming months as a result of the draft legislative programme,
E.underlining the importance that, along with its committees, it attaches to close contacts with national parliaments,
F.whereas the Commission has not fully completed the legislative programme for 1992,
1.Welcomes the new approach adopted by the Commission in its presentation, which is more consistent and clearer in its objectives, and the indication of:
-measures which could give rise to prior consultations with the other institutions and with representatives of the economic and social partners,
-proposals for the consolidation of legislation during the current year,
-policy discussions which the Commission intends to conduct during the year (white papers, green papers),
-international agreements to be negotiated and concluded by the end of 1993,
-measures it intends to put forward within the new pillars of foreign policy and cooperation in justice and home affairs;
2.Instructs its Enlarged Bureau, pursuant to Rule 29a of its Rules of Procedure, to draw up on the basis of these proposals an interinstitutional legislative programme in agreement with the Commission and, if it so wishes, the Council, on measures to be adopted during 1993, based on the following requirements;
3.Calls on all the institutions to adopt, as a matter of priority, all measures connected with the European growth initiative and additional proposals to combat unemployment and to ensure that they are coordinated under the Structural Fund, research (IVth Research and Technology framework programme), transport networks and the management of resources under the future EEA agreement;
4.Calls for the interinstitutional legislative programme to be supplemented particularly as regards measures connected with the completion of the internal market and, in particular, the free movement of persons and the right of residence for students, policies on the environment, public health and consumer protection, energy, the social aspects of transport policy and Commission proposals for the common and foreign security policy and cooperation in the fields of justice and home affairs;
5.Calls on the Commission to include systematically, in accordance with the 1982 Interinstitutional Agreement, proposals on the legal basis for budget headings entered by the budgetary authority, in particular for the CONVER programme, the student exchange network and the gradual integration of the ECSC budget;
6.Hopes that, in agreement with the Commission and Council, the following proposals will be adopted:
-implementation of the Social Charter;
-implementation of a European industrial policy, on the basis of its resolution of 11 July 1991 on industrial policy in an open and competitive environment;
-company law;
-revision of Council Decision 87/373/EEC of 13 July 1987 on commitology;
7.Hopes that, given the vital political importance of these measures, the Commission will bring forward, no later than the end of April 1993, proposals for:
-the right to vote and stand for election to the European Parliament in the Member State of residence;
-asylum, immigration and visa policy,
-combating racism and xenophobia,
8.Urges the Council to conclude its work on outstanding proposals in priority areas at the earliest opportunity;
9.Calls on the Commission to specify the legal bases of the various proposals wherever possible when submitting its legislative programme in future;
10.Requests that, as soon as all the Member States have ratified the Treaty on European Union, the Commission should forward to Parliament a full list of the proposals now pending for which the entry into force of the Treaty would entail a change in legal basis or procedure, so that Parliament's committees can deliver their opinions in good time;
11.Asks, in relation to Annex I of the legislative programme concerning the proposals to be reviewed or withdrawn after consultation of Parliament, that the Commissioners responsible should explain the Commission's position to the relevant parliamentary committees; stresses that Parliament will deliver its opinion at the earliest opportunity on the basis of the proposals made by the parliamentary committees and in relation to developments in the policy concerned;
12.Welcomes the proposals for consolidation set out in the draft legislative programme and will endeavour to consider them as soon as possible; requests that Community legislation on insurance and credit institutions be included in this exercise, which should be developed into a comprehensive consolidation programme, while at the same time giving priority to those areas of legislation that are of direct concern to EC citizens;
13.Instructs its Enlarged Bureau to revise, pursuant to paragraph 4 of its abovementioned resolution of 10 February 1993 and in cooperation with the Commission, the Interinstitutional Code of Conduct;
14.Instructs its Enlarged Bureau to forward the interinstitutional legislative programme to the parliaments of the Member States and to publish it in the Official Journal of the European Communities.
15.Instructs its President to forward this resolution to the Council, Commission and the Court of Justice.
