Resolution on the death of Joy Gardner
The European Parliament,
A.whereas the third pillar of the Maastricht Treaty on European Union introduces a competence on home and justice affairs and immigration and visa control in particular,
B.whereas Joy Gardner died from suffocation whilst being detained in her home by British immigration and police officials,
C.whereas Joy Gardner's death was probably as a result of the use of restraining belt, cuffs and gag,
D.whereas Joy Gardner had committed no crime against person or property,
E.whereas it appears that Member States are covertly collaborating in the detention and expulsion of illegal immigrants,
1.Calls on the British Government to institute an independent public inquiry into the death of Joy Gardner;
2.Calls on the Council to make available immediately its policy decisions on immigration and deportation practices and procedures;
3.Calls on the Council to establish and declare guiding principles for the policy and enforcement of detention and deportation of illegal immigrants;
4.Instructs its President to forward this resolution to the governments of the Member States and the Council.
