Resolution on the proposals pending before the Council on 31 October 1993 in the fields of transport and tourism for which entry into force of the Treaty on European Union will require a change in the legal base and/or a change in procedure
The European Parliament,
-having regard to the list drawn up by the Commission of proposals pending before the Council on 31 October 1993 for which entry into force of the Treaty on European Union will require a change in the legal base and/or a change in procedure (COM(93)0570 - C3-0369/93),
-having been informed in a letter of 15 November 1993 from the President of the Commission of the texts of the Commission proposals contained in the COM(93)0570 list, which must be adopted in accordance with the procedures laid down either in Article 189b of the EC Treaty (the codecision procedure) or in Article 189c of the EC Treaty (the cooperation procedure),
-having regard to Article 189b(2) of the EC Treaty,
-having regard to the report of the Committee on Transport and Tourism (A3-0430/93),
1.Affirms that on the Commission proposal for a seventh directive on summer-time arrangements (COM(93)0439 - C3-0402/93) it will undertake the first reading as soon as possible under the codecision procedure, as it now considers that the legal base chosen is appropriate;
2.Does not confirm as a first reading pursuant to the codecision procedure its vote of 15 May 1992 on the Commission proposal regarding a European high-speed train network (SEC(90)2402 - C3-0403/93) and so requests the Commission to submit to it by June 1994 a new proposal on this question to take account of the amendments adopted by Parliament in its opinion of 15 May 1992;
3.Confirms as a first reading under the codecision procedure the votes taken on the following Commission proposals, as well as those amendments which the Commission did not include in its amended proposals:
(a)vote of 20 November 1992 on the Commission proposal introducing a declaration of European interest to facilitate the establishment of trans-European networks in the transport domain (COM(92)0015), and, in particular, those amendments which the Commission did not include in its amended proposal (COM(93)0115 - C3-0433/93);
(b)vote of 29 October 1992 on the proposal (COM(92)0108 - C3-0510/93) for a directive relating to the mechanical coupling devices of motor vehicles and their trailers and their attachment to these vehicles.
4.Confirms as first readings under the cooperation procedure the votes taken on the following Commission proposals as well as those amendments which the Commission did not include in the amended proposals:
(a)vote of 18 November 1976 on the proposal (COM(75)0490-08) for a regulation concerning a system for monitoring the markets for the carriage of goods by rail, road and inland waterway between Member States;
(b)vote of 7 February 1977 onthe proposal (COM(75)0465) for a regulation on the harmonization of certain social provisions relating to goods transport by inland waterway;
(c)vote of 16 January 1981 on the proposal (COM(80)0360) for a directive concerning the enforcement, in respect of shipping using Community ports, of international standards for shipping safety and pollution prevention;
(d)vote of 19 June 1981 on the proposal (COM(80)0809) for a decision setting up an information and consultation procedure for relations and agreements with third countries in the field of transport by rail, road and inland waterway;
(e)vote of 11 September 1986 on the proposal (COM(85)0090-04) concerning a decision setting up a consultation procedure on relations between Member States and third countries in shipping matters and on action relating to such matters in international organizations;
(f)vote of 11 September 1986 on the proposal (COM(85)0090-05) for a directive concerning a common interpretation of the concept of 'national shipping line';
(g)vote of 17 June 1988 on the proposal (COM(88)0523-02) for a decision on the common position to be adopted by Member States when signing and ratifying the United Nations Convention on Conditions for the Registration of Ships;
(h)vote of 16 November 1988 on the proposal (COM(88)0021-02) for a directive on standard checking procedures for the implementation of Council Regulation (EEC) No. 3820/85 on the harmonization of certain social legislation relating to road transport and Council Regulation (EEC) No. 3821/85 on recording equipment in road transport;
(i)vote of 23 May 1988 on the proposal (COM(88)0577-02) for a decision on consultation and coordination between Member States in the field of air traffic services and air traffic flow management;
(j)vote of 23 May 1989 on the proposal (COM(88)0577-03) for a decision on extending Decision 78/174/EEC to the field of sea and air transport infrastructure;
(k)vote of 23 May 1989 on the proposal (COM(88)0577-04) for a recommendation on a flexible and efficient use of air space;
(l)vote of 14 September 1990 on the proposal (COM(88)0706) for a directive on speed limits for certain categories of motor vehicles in the Community;
(m)vote of 23 May 1989 on the proposal (COM(88)0707) for a directive relating to the maximum permitted blood alcohol concentration for vehicle drivers;
(n)vote of 16 May 1989 on the proposal (COM(89)0201) for a directive fixing the final expiry date for the derogation granted to Ireland and the United Kingdom on the weight and dimensions and certain other technical characteristics of certain road vehicles;
(o)vote of 26 October 1990 on the proposal (COM(89)0266-02) for a regulation establishing a Community shipping register and providing for the flying of the Community flag by sea-going vessels as well as the resolution of 16 September 1993;
(p)vote of 26 October 1990 on the proposal (COM(89)0266-04) for a regulation on a common definition of a Community ship owner and also the resolution of 16 September 1993 on the same subject;
(q)vote of 13 December 1990 on the proposal (COM(90)0100) for a regulation on consultation between airports and airport users and on airport charging principles;
(r)vote of 11 June 1991 on the proposal (COM(90)0486) for a directive amending Directive 85/3/EEC on the weight, dimensions and certain technical characteristics of certain road vehicles;
(s)vote of 13 December 1991 on the proposal (COM(92)0652-02) for a directive for the European system for observing the inland goods transport markets;
(t)vote of 15 May 1992 on the proposal (COM(91)0004) for a directive on the appointment of an officer for the prevention of the risks inherent in the carriage of dangerous goods in undertakings which transport such goods, and on the vocational qualification of such officers;
(u)vote of 30 October 1992 on the proposal (COM(92)0105) for a regulation on the transfer of controls in the field of road and inland waterway transport to the Community's external frontiers;
5.Notes that the procedures with regard to the amended proposal for a Council decision on a consultation and authorization procedure for agreements concerning commercial aviation relations between Member States and third countries (COM(92)0434 - C3-0145/93) are not covered by the Commission in its proposal COM(93)0570 and therefore asks to be consulted again in accordance with Article 189c (cooperation);
6.Notes that proposal COM(92) 0230-05 for a regulation amending Regulation (EEC) No. 1107/70 on the granting of aids for transport by rail, road and inland waterway was already adopted by the Council on 7 December 1992, and accordingly requests that it should not be included by the Commission in its proposal COM(93)0570;
7.States that as regards the following proposals in Commission document COM(93)0570 it will undertake the first reading under the cooperation procedure as soon as possible:
(a)proposal COM(93)0217 for a directive on the minimum level of training for maritime occupations;
(b)proposal COM(93)0218 for a directive on common rules and standards for ship inspection and survey organizations;
(c)proposal COM(93)0406 for a directive establishing the fundamental principles governing the investigation of civil aviation accidents and incidents;
8.Calls on the Commission to amend its proposals accordingly;
9.Instructs its President to forward this opinion to the Council, the Commission, the Economic and Social Committee and the Committee of the Regions.
