Resolution on the legal base of the Commission proposal for a Council decision on the creation of a Community data base on road accidents (COM(93)0348 - C3-0368/93)

The European Parliament,

-having regard to the Commission proposal to the Council (COM(93)0348 - C3-0368/93),

-having regard to Rule 53 of its Rules of Procedure,

-having regard to the report of the Committee on Transport and Tourism and the opinion of the Committee on Legal Affairs and Citizens' Rights (A3-0376/93),

1.Disputes the appropriateness of the legal base proposed by the Commission;

2.Considers that the Commission proposal should be based on Article 75 of the EC Treaty;

3.Calls on the Commission to amend its proposal accordingly, pursuant to Article 189a(2) of the EC Treaty;

4.Instructs its President to forward this resolution to the Commission and, for information, to the Council.
