I.Decision on the first request for the parliamentary immunity of Mr Riskær Pedersen to be waived

The European Parliament,

-having received a request for the parliamentary immunity of Mr Riskær Pedersen to be waived, forwarded by the Danish Minister for Foreign Affairs on 5 July 1993 and announced on 15 July 1993 by the President of the European Parliament,

-having regard to Article 10 of the Protocol on the privileges and immunities of the European Communities of 8 April 1965, and to Article 4(2) of the Act concerning the election of representatives to the European Parliament by direct universal suffrage of 20 September 1976,

-having regard to the judgements of the Court of Justice of the European Communities of 12 May 1964 and 10 July 1986,

-having regard to Article 57 of the Danish Constitution,

-having regard to Rule 6 of its Rules of Procedure,

-having regard to the report of the Committee on the Rules of Procedure, the Verification of Credentials and Immunities (A3-0030/94),

1.Decides to waive the parliamentary immunity of Mr Riskær Pedersen with the sole aim of enabling prosecution proceedings to be brought;

2.Decides not to waive the parliamentary immunity of Mr Riskær Pedersen as regards his personal freedom so that, until a final sentence is passed, he will remain immune from any form of detention or remand or any other measure which prevents him from performing the duties proper to his mandate;

3.Instructs its President to forward this decision and the report of its committee without delay to the appropriate authorities of Denmark, with a request that he should be informed of any judicial rulings made as a consequence of the waiver of immunity.

II.Decision on the second request for the parliamentary immunity of Mr Riskær Pedersen to be waived

The European Parliament,

-having received a request for the parliamentary immunity of Mr Riskær Pedersen to be waived, forwarded by the Minister of Justice of the French Republic on 13 July 1993 and announced on 14 September 1993 by the President of the European Parliament,

-having regard to Article 10 of the Protocol on the privileges and immunities of the European Communities of 8 April 1965, and to Article 4(2) of the Act concerning the election of representatives to the European Parliament by direct universal suffrage of 20 September 1976,

-having regard to the judgements of the Court of Justice of the European Communities of 12 May 1964 and 10 July 1986,

-having regard to Article 16 of the French Constitution,

-having regard to Rule 6 of its Rules of Procedure,

-having regard to the report of the Committee on the Rules of Procedure, the Verification of Credentials and Immunities (A3-0030/94),

1.Decides to waive the parliamentary immunity of Mr Riskær Pedersen with the sole aim of enabling prosecution proceedings to be brought;
