Resolution on the legal basis of the draft Council decision on inter-administration telematic networks for statistics relating to the trading of goods between Member States (COMEDI) (COM(93)0073 - 4493/94 - C3-0118/94 - COD 454)

The European Parliament,

-having regard to the Commission proposal to the European Parliament and the Council (COM(93)0073 - COD 454),

-having regard to its opinion at first reading on the Commission proposal (COM(93)0073),

-having been consulted by the Council on the appropriateness of Article 235 of the EC Treaty as legal basis (4493/94 - C3-0118/94),

-having regard to the opinion of the Committee on Legal Affairs and Citizens' Rights on the legal basis,

-having regard to Rule 53(4) of its Rules of Procedure,

-having regard to the report of the Committee on Economic and Monetary Affairs and Industrial Policy and the opinions of the Committee on Legal Affairs and Citizens' Rights and the Committee on Budgets (A3-0340/94),

1.Disputes the legal basis proposed by the Council;

2.Considers that the Commission proposal should be based on Article 129d, third paragraph, of the EC Treaty;

3.Calls on the Commission to alter its proposal accordingly;

4.Instructs its President to forward this resolution to the Council and Commission.
