Decision on the text confirmed by the Council following the conciliation procedure on the proposal for a European Parliament and Council Directive on the application of open network provision (ONP) to voice telephony (C4-0056/94)

The European Parliament,

- having regard to the text confirmed by the Council pursuant to Article 189b(6) of the EC Treaty, C4-0056/94 - (COD)0437,

- having regard to its opinion at first reading on the Commission proposal to Parliament and the Council, COM(92)0247 - C3-0376/92,

- having regard to its decision at second reading on the common position,

- having regard to the Commission's opinion on Parliament's amendments to the common position,

- having regard to Article 189b(6) of the EC Treaty,

- having regard to Rule 78 of its Rules of Procedure,

- having regard to the report of its delegation to the Conciliation Committee (A4-0001/94),

1. Rejects the Council text;

2. Instructs its President to declare the proposed act not adopted and to forward this decision to the Council and Commission.
