Resolution on the communication from the Commission including a draft Council resolution on the development and implementation of the European Environment Agency established by Council Regulation (EEC) No 1210/90 of 7 May 1995

The European Parliament,

-having regard to the Commission communication to the Council and the European Parliament, COM(95)0325 - C4-0412/95,

-having regard to Rules 51, 61 and 143 of its Rules of Procedure,

-having regard to the report of the Committee on the Environment, Public Health and Consumer Protection (A4-0234/95),

1.Considers that the setting-up of the Agency and its environment information and observation network (EIONET) can only be achieved if there is full transparency concerning its tasks and the way these are fixed;

2.Recalls, however, its resolution of 15 March 1995 on the Commission's work programme and the legislative programme for 1995, which states that the review of the Regulation establishing the Agency, foreseen in Article 20 thereof on the basis of a report from the Commission should take place this year;

3.Reminds the Commission and the Council that, under the terms of Article 20 of the Regulation, the Commission's report should contain appropriate proposals so that the Council can decide on further tasks for the Agency, notably in the monitoring of the implementation of Community environmental legislation, after consulting the Parliament;

4.Notes that the Regulation establishing the Agency, as a legal act, can only be modified by an act of the same nature and cannot be modified by means of a Council resolution or other document on which the Parliament is not consulted;

5.In view of the current situation of the Agency, approves the Commission's intention not to bring forward such proposals for the time being, but calls on the Commission to produce its report as soon as possible;

6.Invites the Council to associate itself with this resolution in the spirit of loyal cooperation between the institutions;

7.Instructs its President to forward this resolution to the Council and Commission.
