Resolution on the implementation of a single market for postal services

The European Parliament,

-having regard to Rule 37(2) of its Rules of Procedure,

-having regard to the Commission Green Paper on the development of the single market for Postal Services (COM(91)0476),

-having regard to its resolution thereon of 22 January 1993, in which it called on the Commission to draw up a package of proposals to establish a single market for postal services,

-having regard to its subsequent resolutions of 25 June 1993 on the single market for postal services and 29 October 1993 on postal services,

-having regard to its resolutions on the Legislative Programme,

-having regard to the "code of conduct" agreed between the Commission and the European Parliament and adopted on 15 March 1995,

-having regard to the Commission proposal for a Directive on common rules for the development of Community postal services and the improvement of quality of service (COM(95)0227),

-having regard to the Draft Notice on the application of the competition rules to the Postal Services and in particular on the assessment of certain state measures relating to Postal Services,

A.whereas the Draft Notice ignores the Commission proposal for a Directive on common rules for the development of Community postal services,

B.whereas the Draft Notice applies Article 90(3) as legal basis to the postal services, whilst the Directive applies Article 100a,

1.Calls on the Commission to withdraw its Draft Notice on the application of the competition rules to the Postal Services and in particular on the assessment of certain state measures relating to Postal Services;

2.Instructs its President to forward this resolution to the Council, the Commission, the Economic and Social Committee, the Committee of the Regions, the governments and parliaments of the Member States and the relevant trade unions.
