Formally requests the General Prosecutor's Office,
a. to solicit urgently the Governments of States member of NATO to hand over
immediately to the Office of the General Prosecutor all the documents in their
possession (written documents, testimonies, snapshots, television and satellite
records, telephone conversations, etc.) able to prove the crimes committed
under
the order of the Yugoslav Government and/or of Serbian and Yugoslav
Presidencies by Serbian and Yugoslav army and forces, as well as by the
paramilitary forces, against civilian populations of Kosovo, documents that
have
contributed to determine, after the failure of the diplomatic action, and
according
to what has been declared by Governments in parliamentary sessions, the
recourse to military intervention;
b. to acquire and evaluate the analogue documentation of crimes committed and
being committed under the order of the highest Yugoslav authorities against
their
own citizens of Albanian origin, inhabitants of Kosovo, after the beginning of
the NATO military intervention, also considering the Geneva Convention on
humanitarian law in the time of war;
c. to acquire the testimonies of the OSCE observers, of officers of UNHCR, of
European Commission, of International Red Cross, of NGOs that have been
operating in Kosovo, etc.
d. to immediately acquire the testimonies that are being collected by the
General
Prosecutor of Albania and to solicit analogue initiative by General Prosecutor
Offices of every country, including the Yugoslav Federation, where refugees
from
Kosovo have arrived, or are going to arrive;
e. to emphasize to the Yugoslav Government that any limitation to freedom of
information is and will be taken as a willful expression of hiding of evidence;
f. to notify the Yugoslav authorities of the arrest warrant for Mr Arkan,
already
wanted for crimes committed in Bosnia, whose active presence, together with his
groups, is currently acknowledged in Kosovo.
The undersigned requests the Prosecutor's Office, as soon as minimal and
sufficient elements proving the responsibility of Yugoslav President Slobodan
Milosevic in the chain of command for committing crimes will be acquired, to
proceed immediately with his indictment for war crimes and crimes against
humanity, and immediately issue the warrant for his arrest.
