The congress of the Radical Party,
Considering that:
-The death penalty is still anticipated in 143 of the 187 states of the international community (127 for common crimes and 16 for exceptional crimes), even if this is practiced in 106, amongst those several countries with political democracy, the United States and some countries in Europe even if these haven't carried out sentences in the last decades, in Africa and the Mediterranean area, whilst in the republics of the ex-Soviet Union the penal codes are currently being revised;
- in 1991, 2.086 prisoners were executed in 32 countries and in 62 countries 2.703 sentences to death were passed;
Believes that:
- It should be affirmed, without ambiguity, at the highest level, with a Declaration even in the United Nations, as a new subjective right, the right of every living human being to not be executed as a result of a sentence or legal measure, even if this is passed with respect to the law;
- the Resolution of the European Parliament (spokesperson Adelaide Aglietta), approved 12 March 1992, constitutes an important instrument for the affirmation of principle, for the legitimate possibility of interference by foreign policy, at the disposition of governments and parliaments, by militant democrats for the abolition of the death penalty;
- The choice should not be one of "prohibitionism", "negative", but one of rigorous and progressive regulation which would take into account the various diverse historic, cultural, customary and legislative situations which would be taken as a base from which the realization of the carrying out of the expected new subjective right;
- the appeal for the abolition of the death penalty in ex-Soviet Union has been signed by over 620 members of parliament and members of government as well as approximately 200 personalities from all over the world. The mobilitization by the Radical Party during this last year against the death penalty in Cuba, for the abolition in Ukraine and other republics of the ex-Soviet Union, are but the first step in the parliamentry, civil, democratic, non violent action which should characterize the "Campaign for the abolition of the death penalty by 2000".
Approves the following project of initiatives and objectives:
1) To promote the first world wide parliamentary congress for the "Campaign for abolition of the death penalty by 2000" and for the constitution of the first special league. The congress could be held in Rome during Easter of 1993, culminating with a popular march crossing Rome to St. Peter's, at the Vatican, moments before the broadcasting world wide of the Pope's Easter greeting.
2) To organize the presentation of the over 1.000 signature gathered by the Radical Party appeal for the abolition of the death penalty in the ex-Soviet Union, to President Boris Yeltsin and Leonid Kravchok by a delegation of members of parliament and of government as well as personalities from the worlds of science and culture and Nobel laureates who have all signed the appeal.
3) Promote a major campaign of parliamentary action and civil mobilitization, democratic and non violent, starting, first of all, from members of parliament and government - members of the Radical Party - and signatories of the appeal, articulating the questioning of the same text of the law. of motion, or resolution to the end of requesting, in the meantime, a moratorium on the executions for the duration of at least 3 years, presented simultaneously in the various countries and parliaments and supported by the mobilitization of non violent militants and by the information of the public opinion in the same countries.
4) Promote at the U.N. headquarters the hypothesis of an international court with competence to judge, in this case, behaviour, material, categories of individuals or of presumed guilty with particular reference to coup d'etat, failed or successful, in which occasion the Security Council is authorized to intervene, to impose procedural guarantees for the convicts, a moratorium on executions for a period of 6 months, demanding the respect of this moratorium and in the case that the moratorium is ignored the imposition of sanctions and or denial international recognition.
5) Promote a regional agreement for the abolition in Africa, starting with the existing abolitionist states or states that have not practiced the death penalty in over ten years, and for the Mediterranean countries, in collaboration with the Organization for Peace amongst the People of the Mediterranean, which has joined the Radical Party's campaign for the abolition of the death penalty.
6) Organize a simultaneous demonstration in the greatest number of capital cities with broadcasting of videos of capital punishment.
