It was finished yesterday in Noginsk (Moscow region) the first day of trial process against Vadim HESSE, member of the Radical Party and ARA who objected military service on political reasons in October last year and was arrested on January 26, this year on the accusation in "evading the regular draft to the military service" (art. 80 of the Criminal Code of Russian Federation).
The judge Elena RASKEVICH leads process, where the interests of the defendant are represented by the lawyer Miroslava DAVYDOVSKAJA, as well as by public defenders Nikolaj KHRAMOV (secretary of ARA) and Sergej SOROKIN (president of Movement Against Violence). The accusation is being supported by the prosecutor Elena FROLOVA. In course of yesterday's court session the witnesses were interrogated: military commissioner of Noginsk district colonel Aleksandr ISKOROTENSKIJ, vice commissioner Aleksandr SEREDOV and Hesse's grandmother Klavdija PATRASHKOVA. At this point the court investigation was finished.
Hesse's lawyer Miroslava DAVYDOVSKAJA told yesterday after the court session: "Everything is clear in this case. It was convincingly proved in the court hall: the military recruitment office of Noginsk district violated all the laws and instructions which only he could violate: from Constitution to the instructions of Regional Recruitment Office. Vadim Hesse cannot be not justified, if only the judge intends to follow her professional duty. As for the process, its first day shows that Mrs Raskevich's approach is fully professional and conscientious. She really strives to establish the facts."
The next session is appointed on Sunday, May 12, at 11:00 AM. At that day there are provided debates of the parties and the final intervention of the defendant. The sentence is also being expected at the say day.
