On June 4, 1997 in the Supreme Court of Russian Federation has been examined the complaint of Vadim Hesse, member of ARA secretariat, against the Decree No. 66 (17.02.1993) of the Ministry of Interior (MVD), which was regulating till the last time the issuing of foreign passports to the citizen. According to the Art. 13 and Art. 26.6 of the Decree, the Visa & Registration Depts. (OVIR) refused the right to leave the country to the conscripts who did not perform the military service. One of the basic human rights, the right on freedom of movement, has been regularly violated by the authorities in favour of the Defense Ministry's interests.

According to this motives, in February 1997 the OVIR of Moscow Region decided to refuse Vadim Hesse to leave Russian Federation. However, the new Federal Law "About the rules of exiting Russian Federation and entering in Russian Federation" was at that time already in force. According to the new law, it was possible to refuse a citizen to leave the country only in case when he was already drafted into the armed forces. Therefore, the ministerial instruction which was issued yet according to the old Soviet law, was at odds with new legislation, but nevertheless was not less successfully used in order to fulfil conscription plans. This was the reason to appeal to the Supreme Court.

The leadership of the MVD one week before the case examination in the Supreme Court has issued a new decree - Decree No. 310 which abrogated before existing rules. This Decree has been presented in the Supreme Court and grounds for the complaint have been eliminated. Since now a citizen cannot be refused to leave the country before his drafting to the military service.

This necessary step in order to the establishment the State of Rule in Russia was inevitable. However it could be done much later, if not the efforts of citizens and organizations working in favour of human rights and democracy in Russia, like the Anti-militarist Radical Association.
