THE OREGON DRUG CONTROL AMENDMENT

Thanks for your interest in The OREGON DRUG CONTROL AMENDMENT, an initiative petition drive requiring 97,681 signatures of Oregon voters by July 1998 to qualify for a statewide vote that same November. When passed the ODCA - a constitutional amendment - will effectively end adult drug prohibition in Oregon as we enter the new millennium.

A Few Benefits of the Oregon Drug Control Amendment:

* Greatly reduces our children's exposure to drugs.

* Reduces drug-related crime, violence, and corruption.

* No more "drug houses" or "crack alleys."

* Gets dealers and addicts off the streets.

* Violent offenders or sell drugs to kids?:

* 1st Conviction requires 100 percent of time.

* 2nd Conviction requires twice the time as 1st.

* 3rd Conviction possible life sentence.

* Reduces overdoses, AIDS, other public health issues.

* Allow for medical uses of marijuana.

* Open up non-drug uses of cannabis, i.e. hemp fiber.

* Promotes temperance, moderation, safety.

We Need Real Drug Control to Protect Our Kids!

The fact is illegal drugs are out of control. Our government has abdicated its responsibilities and now international drug cartels, drug gangs, and criminals on both sides of the law have been put in charge; with obviously disastrous results. On our streets, in our parks and even in our public schools illegal drugs can be found and had by anyone, no matter a tender age.

Everyday we hear of another "major drug bust," but what has not been heard is that for every ton of drug discovered, its estimated at least 10 tons make it to the market. An illegal market that - make no mistake about it - targets our children; resulting in a 50 percent increase in teen-age drug use since 1992.

It's time to admit we can not FORCE adults to stop making, selling and using these drugs; but with the Oregon Drug Control Amendment we will be able to REGULATE them and drive the illegal dealers, addicts, and drug-related gangs out of business and away from our kids.

The Drug Control Amendment will help restore the public's faith in Oregon's justice system. The ODCA will make our neighborhoods safer, it will shift emphasis and free resources to better deal with the root-causes of crime and drug abuse in the first place.

The ODCA may not be a perfect answer to everyone, considerable compromise and modifications may be needed before its passed by the voters; nonetheless I would be happy beyond words if it only to served as a light at the end of the dark tunnel that leads out of this insane war on drugs.

THE OREGON DRUG CONTROL AMENDMENT

Article I Section 42. Control of problem substances.

(1) Whereas the people of the state of Oregon find and declare that in the interest of public health and safety, to protect the young and innocent, to reduce crime, and to reduce as much as humanly possible the harm of substance abuse in Oregon; the State of Oregon shall regulate, tax, and strictly control any and all commercial activity related to any and all problem substances.

(2) No law shall be passed to prohibit adult possession of any problem substance for private personal use; but every individual will be held responsible for their abuse of this right.

(3) Within six months (180 days) after the approval and adoption of this amendment by the people of Oregon, the Legislative Assembly, in consultation with the medical, public health, and law enforcement fields shall place into the Oregon Revised Statutes a list to be titled, The Oregon Schedule of Problem Substances, and the assembly shall enact into law, in such detail as the assembly deem advisable, regulatory provisions relating to the problem substances and shall include but is not limited to:

* Minimum age(s) of not greater than 21 years

* Reasonable limits on adult personal possession

* Adequate public health and consumer safeguards

* Licensure of approved manufacturers and distributors

* Penalties for violations, provisions for enforcement

* Promotion of temperance, moderation, and safety

* Indigent addict management programs

(4) Within six months (180 days) after the approval and adoption of this amendment by the people of Oregon, the Governor, based on recommendations made by the Oregon Department of Corrections shall pardon those named individuals in custody, on parole, or probation solely for convictions made exculpatory in light of this amendment. Pending adjudications, based solely on laws nullified by this amendment, are hereby dismissed.

(5) Within six months (180 days) after the approval and adoption of this amendment by the people of Oregon, individuals convicted of illegal distribution of any problem substance to a minor, or any violent crime while under the influence of any problem substance that individual shall be required to serve one-hundred percent of their sentence and shall not be eligible for pardon, parole, or early release. A second conviction for same shall require a double penalty, and a third conviction for any of the above shall require a life sentence on a finding of guilty by a jury of twelve (12) unanimous jurors.

(6) Legislation relating to this matter will operate uniformly throughout the state and all individuals shall be treated equally; and all provisions, laws, regulations and guidelines shall be carefully constructed for the accomplishment of this amendment's stated purposes in the first part.

(7) If any part of this section is held to be invalid for any reason, then the remaining parts shall not be affected but shall remain in full force and effect.
