SOMMARIO. Documento conclusivo redatto dalla Commissione delle Comunità Europee da sottoporre al Consiglio, relativamente alle conclusioni dei negoziati con il Canada nella disputa sulla pesca nel Nord Atlantico.
Following the extension by Canada on 3 March 1995 of its coastal Fisheries Protection Act to permit the arrest of vessels flying the flag of Spain or Portugal in the High Seas outside the canadian 200 miles zone, and the subsequent arrest by Canada of a vessel flying the flag of Spain on 9 March 1995 and further incidents, a Delegation of the European Commission has been meeting with a Delegation of the Government of Canada since 16 March 1995, in order to resolve the dispute.
The outcome of these negotiations is reflected in the Agreed Minute and an Exchange of Letters and an Exchange of Notes, now submitted to the Council. Essentially, the two Parties have agreed to enhance cooperation on management and conservation of fisheries resources in the context of the NAFO Convention, particularly with regard to control and enforcement measures, and to the allocation of the total allowable catch of Greenland Halibut in the area. The European Commnity has also obtained an undertaking from Canada that its disputed legislation covering the vessels of Spain and Portugal shall be repealed and that all pending proceedings against the vessel "ESTAI" shall be settled satisfactorily before the provisional application of the Agreement..
The Commission proposes to the Council to authorize the Commission to sign the Agreed Minute to permit its provisional application and to proceed to the Exchange of Letters and Notes agreed with Canada.
